Who Is Eligible for Expungement in Washington State?

As long as you meet certain requirements, you can vacate both felony and misdemeanor convictions in Washington state. There are different eligibility rules for different types of criminal charges. 

Vacating a Felony Charge in Washington

If you have a felony conviction, your eligibility for expungement will depend on the type of offense and the amount of time that has passed since you obtained a certificate of discharge. This document states that you have completed the requirements of your conviction.

To vacate a felony conviction, you will need to meet the following time limit requirements:

  • If you have a class C felony, you can apply five years after the certificate of discharge was issued.
  • If you have a class B felony, you can apply for expungement 10 years after the certificate was issued.
  • If you have a class A felony, you may not qualify for expungement. Speak to an attorney to determine your eligibility.
